KAMPALA: Toothless KCCA Speaks Out on Ham Construction Atop Drainage Channel

An obviously toothless Kampala City Council Authority (KCCA) has spoken out on its failure to stop Hamis Kiggundu from proceeding with construction of an illegal structure on Jugula Channel in downtown Nakivubo.

 

Kiggundu using his M/S Ham Enterprises Uganda Ltd is currently carrying out an illegal construction on Plots 26 and 28 in Nakivubo.

 

The construction on Jugula Channel which feeds into Nakivubo Channel has caused massive flooding on St. Balikuddembe Market, popularly known as Owino resulting into colossal losses among traders.

 

In a press statement dated Monday, 18th November, 2024, the hapless KCCA says it stopped Ham’s illegal construction on Jugula Channel on 11th November, 2024 in exercise of its authority under Section 46 of the Physical Planning Act, 2010.

 

“The Order also required the Company to restore the drainage Channel within seven days. Unfortunately, this directive has been disregarded, with construction continuing without the necessary permits,” reads KCCA’s statement in part.

 

KCCA which is apparently at a loss, says Ham insists that he has approved Building Plans issued in 2017.

 

However, according to KCCA, the Approval has expired as outlined in Section 38 of the Building Control Act, 2013 which does not permit construction on a drainage channel.

 

Owino market is a cornerstone of Kampala City’s economic activities and provides livelihoods to thousands of traders as a hub for poverty alleviation.

 

Whereas, KCCA asserts that it is committed to enforcing Urban Planning and Development Control laws to safeguard public safety and promote economic development, everyone is left wondering who is stopping KCCA from doing what it says.

 

This is not the first time KCCA issues orders which are ignored.

 

On 7th November, 2024, KCCA again issued an order stopping ongoing development in the Bugolobi-Namuwongo wetlands by Majestic Commodities Ltd.

 

However, construction on the said plots comprising of 1-5 Mpanga Drive and 67, 69, 71, 73-81 Mpanga Close are ongoing in complete disregard of the order.
