Court Blocks Mbale City Council Attempt to Restrain Central Investment Co. From Collecting Street Parking Fees

Mbale high court has dismissed an application by Mbale City council restraining Central Investment Agency Ltd and Mbale Truck and pick-ups Drivers Association from collecting fees from street parking and loading and offloading.

Last month, Mbale City Council  rushed to Mbale high court with an interim order against bthe two companies on allegations that the contractors are performing illegally, and their payments to council were not matching the agreed amounts.

According to their lawyer who is under Nagulu & Mugoda Advocates Eddie Nagulu, the court dismissed interim application which city council had filed before the court.

“We have raised objection before main application, that the documents they filed were not competent.” He added.

“Mbale City council has no mandate to remove the central investment and Mbale Truck and pick-ups Drivers Association from managing fees on the streets of Mbale.” He said.

He said, the ruling shall be delivered by the court on 25th this month on the main application whether the two contractors will be restrained from the streets from Mbale.

Wafuba Muhammed director of Central investment agency shortly after court told  media that, Mbale city council had taken them to court to be granted orders to remove them from street parking revenue collection.

“Court has dismissed an interim application because it’s incompetent, and the main ruling is on 25th and we thank our lawyer Eddie Nagulu for the good defense.” Wafuba said.

“It’s not true that we are illegally managing revenue in the city.

They permitted the division town clerks to take charge of the revenue collection on their behalf  and the money we have been remitting on the accounts of the division councils,” he noted.

Mr. Wafuba said, “We were given a tender but shortly after starting work, the City council began construction of Naboa and cathedral Avenue roads which frustrated the performance of revenue collection.

Phillip Kiza vice chairman of Mbale Truck and pick-ups Drivers Association thanked Court for showing justice.

He added that, Mbale City council has failed to do their work and just wants to bring confusion in town among the drivers.

However, the City Council Spokesperson, James Kutosi told the media  that, they have issues with Central investment and Mbale Truck and pick-ups Drivers Association over managing the fees in the city.

Kutosi said, court has set 25th this month to give the final ruling.
“So let’s wait for the outcome that’s when we shall have what to say in details.” He said.
