A former employee of FINCA Mbale branch has been ordered by the Chief Magistrate’s Court LDC to refund Shs14,952,335 that she used to receive from Kumakech Isaac when he was abroad studying.
The ruling delivered by Acting Senior Principal Magistrate, Grade One, His Worship Kiirya Martins found Patience Ngaimita guilty of receiving the said monies from Kumakech who was then pursuing a Masters Degree St. Thomas University in the United States of America.
The ruling delivered on Friday, 15th September, 2023 says the two met on Facebook and developed intimacy and became girlfriend and boyfriend maturing into a proposal for marriage.
Brief facts obtained by this website indicate that the two hatched a plan and agreed to start up a family business. They also agreed to form a company which came to be called LIVING ROOM LIMITED.
Kumakech then started sending money to Ngaimita for the alleged business. This was however, not to take place with Ngaimita reneging on the arrangement and instead started depositing the money on her Mobile Money Account and using it for her personal gain.
Ngaimita had however argued that the money sent to her was for personal upkeep and not business and that although she sent a business proposal to Kumakech, he never responded.
The Magistrate however ruled that basing on the fact that she ‘tendered’ in a resignation letter to her employer which was never received by the same shows that her actions were fraudulent.

He also noted that the monies were sent over a period of time, an indication that it meant for a purpose.
He therefore ordered her to pay back the Shs14,952,335 she received from the time of creation of the company at an annual interest rate of 25% and additional Shs1M as punitive damages for having acted fraudulently.
