The National Resistance Movement (NRM) Party flagbearer for the recently concluded Kawempe North by-elections has filed an election petition in the Civil Division of the High Court.
Faridah Nambi Kigongo avers that the Electoral Commission and NUP’s Nalukoola did not follow the provisions of Parliamentary elections act relating to elections.
Nambi who filed the petition on Friday, 11th April, 2025 wants a fresh election and prosecution of Mr Elias Nalukoola and his agents for offenses allegedly committed in the Kawempe MP by-election.
Addressing the media after filing the petition, Nambi’s lawyer, Ahmed Kalule Mukasa said their petition is based on two broad grounds.
He says the grounds are that the Electoral Commission and Nalukoola did not comply with the provisions of Parliamentary elections act relating to elections and that the non-compliance and failure to follow those provisions affected the election result in a substantial manner.
He says 16, 640 voters from 14 polling stations were disenfranchised because the electoral commission did not announce their results and their choice is unknown.
He argues that 16,640 votes is significant enough to affect the result of the election after all the election difference between Nalukoola and Nambi is slightly over 8,000 meaning the undeclared 16, 640 votes have the capacity to significantly alter the results of the election.
Secondly Nambi accuses NUP of campaigning during the Election Day at various polling stations and obstructing voters from voting on the Election Day. They also allege that NUP obstructed Election officials from carrying out their duty on the Election Day.
Nambi and her team also allege that Nalukoola and his agents bribed voters before and during the Election Day.
An application filed by Faridah Nambi Kigongo, the NRM’s Flagbearer for the March 13th Kawempe North MP bye-election seeking a vote recount has flopped even before being heard.
In March, Nambi had run to Kawempe Chief Magistrate’s Court in Miscellaneous Cause No. 22/2025 to have a vote recount. However, in a quick change of mind the Application was withdrawn on 25th March, 2025.
Nambi lost to NUP’s Nalukoola who garnered 17,939 votes against her 9,058 votes as gazzetted by the Electoral Commission.
