Muslim lawyers under their body Uganda Muslim Lawyers Association have dragged to court the Mufti of Uganda Sheikh Ramadhan Mubajje and Businessman Justus Kyabahwa.
The Lawyers led by their President and Publicity Secretary say the trio of Mubajje, Al hajji Mugalu Ramadhan, former Secretary General and Justus Kabahwa are engaged in syndicated corruption to swindle Muslim property.
The lawyers who filed their case on Monday, 11th December, 2023 at the Civil Division of the High Court, Kampala want court to cancel the land sale agreement between Mubajje and Kyabahwa.
They are challenging the transaction between UMSC and Justus saying it was tainted with illegalities, fraud, syndicate among others and want the transaction declared null and void.
They say the transaction was an illegality from the beginning because by the time the transaction took place, the land was already occupied by other parties, and that there was a subsisting sublease and knew the land could not be transferred to Kabahwa.
They also claim that even the litigation by Kabahwa is being syndicated and supported by the Mufti and former Secretary General.
This is not the first time, the Lawyers Association has clashed with Mufti Mubajje over sale of Muslim property.
In July, 2020, Uganda Muslim lawyers Association threatened to sue UMSC head Mufti Sheikh Ramathan Shaban Mubajje in his personal capacity for illegally selling Muslim properties.
Lawyers then accused Mubajje of selling two square miles of land in Lwemiyaga District, Ntuusi Village owned by Muslims which is under UMSC custody.
Hajji Ramathan Mugalu, the secretary general of UMSC admitted that they decided to sell the said land because it was lying in waste and they were not earning anything from it.
He added that the money from the sale of the said land was going to be used to buy a commercial building in Kampala.
Sources at UMSC told this website that there is a dilapidated building along Martin road Kampala which UMSC plans to buy but some leaders want to embezzle some of the money.
Sources further revealed that UMSC plans to collect Shs.5m in rent monthly from the building.
However, the Muslim lawyers accuse Mubajje of failing to manage and administer Muslim properties as a trustee.
When contacted, Mugalu advised the disgruntled lawyers that instead of going to court they should come to UMSC and advise them on how things should be done.
This is not the first time that Mubajje is being dragged to court for illegally selling Muslim properties, he was recently acquitted by Buganda Road Magistrate’s court after the said sold properties were bought back by the president from city tycoons who bought it from UMSC towards the 2016 general elections.
