An enforcement officer who is accused of feasting on a first year University Student alongside his fellow workmate accused of later sending the victim obscene WhatsApp messages have been remanded to Luzira Prison, where they will enjoy free accommodation and meals.
The accused persons identified as Ismail Osena, 36, of Salaama Road in Makindye Division, and Julius Mukisa, 21, both appeared in Court on October 6, 2026, before Buganda Road Grade One Magistrate, Her worship Jalia Basajjabalaba.
According to the charge sheet, Osena is accused of rape under sections 110 and 111 of the Penal Code Act, while his co-accused Mukisa was indicted with cyber harassment under Section 25(1) and (2)(a) of the Computer Misuse Act.
Prosecution informed court that the incident involving Osena occurred on September 22, 2026, at ABC2 New View Guest House in Kampala.
Mukisa is accused of sending the woman obscene and indecent messages, requests and proposals through WhatsApp between September 23 and 27, 2026.
While in the court docket, Osena was not allowed to take plea to the rape charge as the magistrate told him that her court has no jurisdiction at all to hear capital offences and that it’s only the High Court which has jurisdiction to hear such offences.
“This offence is capital in nature and triable only by the High Court. This court will not take a plea,” the magistrate said.
Mukisa denied the cyber harassment charge.
“I deny the charge,” he told court.
Government attorneys led by Diane Hope Masawi asked the court to remand both the accused persons saying investigators had not completed their work.
“Investigations into this matter are still ongoing. The state prays that both accused persons be remanded,” Ms Masawi said.
In response, the magistrate remanded both the accused persons to Luzira Prison until October 19, 2026.
Student falls into horny KCCA’s Trap
The prosecution alleges that the student was first stopped by KCCA enforcement officers on September 22, 2026, after she was allegedly found walking on grass in an area where it was prohibited.
According to the facts read to court, the officers demanded Shs100,000 from the student, which she failed to produce and instead they ordered her to fetch 50 jerrycans of water.
The prosecution alleges that Osena subsequently diverted the student away from the KCCA detention offices and took her to ABC2 New View Guest House, where he allegedly shattered her beyond detection.
“Instead of taking her to the detention offices, the accused diverted her to a guest house,” Ms Masawi told court.
Prosecution alleges that Osena had forceful sexual intercourse with the victim without her consent while at the guest house. After sexual intercourse, it’s reported that naked photographs of the student were taken using a mobile phone.
Similarly, prosecution also alleges that Mukisa later contacted the student using WhatsApp and communications took place between September 23 and 27 at various locations in Kampala.
Mukisa allegedly sent the woman messages, requests and proposals that the prosecution described as obscene and indecent. However, Mukisa denied the allegation when the charge was read to him.
Meanwhile, none of the accused persons applied for bail during Tuesday’s proceedings, no defence lawyer addressed the court, the student whose identity has been withheld was not in court, and no statement from her or her family was presented during the proceedings.
The magistrate adjourned the matter to October 19, 2026, for mention.
