The Kenyan High court sitting at Kilimani courts has declined to stop Senate impeachment trial for DP Gachagua set for Wednesday and Thursday, 16th October – 17th October 2024.

Delivering the much anticipated ruling on the afternoon of Tuesday, 15th October, 2024, Justice Chacha Mwita ruled that Parliament should be allowed to exhaust its authority.

Quoting a Constitutional precedence, Justice Mwita says court is reluctant to question parliamentary procedures as long as it did not violate the constitution.

“Having considered the application by both parties, the prayer for conservatory order has been declined,” ruled Justice Mwita.

He however gave no orders on costs and agreed with the petitioner on his prayer to have his petition heard by a panel of Justices saying the file will be forwarded to the Chief Justice to consider constituting an even number of Justices to hear the petition.

Meanwhile, the Senate will be holding impeachment sitting on Wednesday, 16th October, 2024 and Thursday.

Deputy President Rigathi Gachagua on Thursday, 3rd October, 2024 filed a petition at the High Court seeking the suspension of the impeachment motion lodged against him at the National Assembly.

In his plea to the court, the deputy president sought an order prohibiting the National Assembly from processing, passing, and transmitting to the Senate any resolution made from the motion filed on September 26.

Gachagua’s latest petition follows three other petitions initially filed at the High Court that challenged his looming ouster. However, all of them were dismissed paving the way for the tabling of an impeachment motion.
